The reform of the audiovisual legislation and electoral coverage in Spain

Abstract

Introduction: The purpose of this article is to propose the reform of the regulation in force in Spain on the coverage and treatment of information in the audiovisual media during electoral campaigns, in relation to the mandatory transposition into Spanish legislation, before the end of 2020, of Directive 1808/2018 of audiovisual communication. Methodology: For this, a review of the most relevant legislation in the field is carried out, including the Organic Law of Electoral Regime (LOREG by its acronym in Spanish) of 1985, the different laws of creation of public and private media, General 7/2010 Law of Audiovisual (LGA by its acronym in Spanish), the European Audiovisual Services Directive approved in 2018 and the regulation in other European countries on the organization of electoral debates and disinformation campaigns. Results: Although the 35 years of validity of the LOREG and its jurisprudence condition the legal framework of the audiovisual coverage of the electoral campaigns, it is possible to include  in the transposition and reform of the LGA 7/2010 the regulation of the debates and new measures on the protection of pluralism, independence, and verification against fake news, issues that a group of Spanish academics raised during the public consultation of the Secretary of State for Digital Advancement (SEAD by its acronym in Spanish) of the Ministry of Economy and Business (MEE by its acronym in Spanish) on the transposition of Directive 1808/2018.

Author Biographies

Francisco Campos-Freire, University of Santiago de Compostela

Journalist and Professor of Journalism at the Faculty of Communication Sciences of the University of Santiago de Compostela (Spain). Bachelor’s Degree in Information Sciences from the Complutense University of Madrid, Doctor from the University of Santiago de Compostela, he is also an MBA in Direction and Management of Industrial and Service Companies, a certified European Expert in Management a certified European Expert in Corporate Social Responsibility and Quality Management by the European Organization for Quality (EOQ) and the Spanish Association of Quality (AEC by its acronym in Spanish).  In the journalistic field he began his professional career as a delegate of the regional newspaper La Voz de Galicia in Lugo (1979-1985), deputy director and director of the newspaper La Región de Orense (1985-1990), managing director of the Galician News Agency (AGN by its acronym in Spanish) in 1990-94, general director of the Galician Television Radio Company from 1994 to 2000, and president of the Federation of Autonomous Radio and Television Organizations of Spain (FORTA by its acronym in Spanish) in 1994, 1997, 2001, and 2004. As an academic, he has published about a hundred research articles and a dozen books, including the following titles in recent years: “Management of new journalistic companies” (2008), “The media change” (2009), “The new media scenario” (2010), “Governance and communication in Europe” (2011), and “The management and research of digital social networks” (Cuadernos Artesanos de Comunicación, 2013).

Marta Rodríguez-Castro, University of Santiago de Compostela

Marta Rodríguez-Castro (Santiago de Compostela, Spain) has a degree in Audiovisual Communication from the University of Santiago de Compostela (USC) and a Master's degree in Research applied to media from the Carlos III University of Madrid. She is currently a Ph.D. in Communication and contemporary information at the USC, where she is hired FPU (FPU16/05234) and researcher of the Novos Medios group. His research area is linked to the European public media, paying special attention to its governance, regulation, and financing. His doctoral thesis addresses European public value tests, as well as the proximity media.

Alejandro Gesto-Louro, University of Santiago de Compostela

Alejandro Gesto-Louro has a degree in Journalism from the University of Santiago de Compostela (Spain) with the Final Degree Project entitled Evolution of the financing of European public audiovisual services (2010-2017). Studies in Law by the Autonomous University of Madrid (2014-2016). Currently, he is studying the Master's Degree in Journalism and Communication: New Trends in Production, Management and Diffusion of Knowledge of the Faculty of Communication Sciences of the University of Santiago de Compostela and begins his activity as a researcher, with a special interest in financing, regulation, and innovation of European public media.
